What is a Party Wall and the Party Wall Act?
Put simply, a Party Wall is a wall shared between two owners.
The Party Wall 1996 etc. Act is a legal framework to enable work to be done on, and close to, party walls while protecting adjoining owners.
Works covered by the act include:
- Building on a boundary that is not built on (e.g a new wall for a rear extension etc)
- Works to shared walls and structures (e.g. inserting steel beams, removing chimney breasts etc)
- Excavations close to a neighbour’s property (e.g foundations, basements etc).
Do I have to use the Party Wall Act?
The Act is separate from planning permission or building regulations. If your proposed works come under the Act you are legally required to use it.
The Act is invoked by the person doing work serving ‘notice’ of their intended works to Adjoining Owners. You can do this yourself, but if done incorrectly the whole process can become invalid so most people prefer us to do it for them.
What is a Party Wall Surveyor?
Once the building owner has served notice, the adjoining owner can either ‘consent’ (not have concerns) or ‘dissent’ (have concerns) about the proposed works.
If they ‘dissent’ then Party Wall Surveyor(s) are appointed to resolve matters by drawing up a party wall agreement (called an ‘Award’).
When choosing a Surveyor it makes sense to appoint someone well versed in the workings of the act. All our surveyors are members of the FPWS (Faculty of Party Wall Surveyors) and follow the FPWS Code of Conduct.
Why is the Act useful?
It is intended to prevent and resolve disputes. It enables building owners to build and adjoining owners to be protected.
Sounds good, so what's the problem?
While well intended, quirks in the act mean it can be complicated/confusing to administer and understand. Anyone can be a Party Wall Surveyor and it’s easy for neighbours to fall out. A few unscrupulous surveyors take advantage of this to maximise their earnings.
